1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and TopDeals India (“we”, “us”, or “our”), governing your access to and use of topdealsindia.com and all associated subdomains, tools, price trackers, and deal alerts (collectively, the “Platform”).

By accessing, browsing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Affiliate Disclosure. If you do not agree to these Terms, you must immediately discontinue using our Platform.

2. Nature of Platform & Role of TopDeals India

TopDeals India operates strictly as an intermediary and content aggregator under Section 2(1)(w) of the Information Technology Act, 2000.

• We are NOT a seller or retailer: TopDeals India does not own, stock, warehouse, sell, package, ship, or deliver any physical or digital merchandise displayed on the Platform.
• Transactions Occur on Third-Party Merchant Platforms: When you decide to purchase a product or redeem a coupon, you will be redirected to the respective retailer or merchant website (e.g. Amazon.in, Flipkart, Myntra, Ajio, Croma, Tata CLiQ, Samsung, etc.).
• Contract of Sale: Any commercial contract for the purchase of goods or services is strictly between you and the respective third-party merchant. TopDeals India is not a party to such transactions.

3. Pricing, Deals & Coupon Accuracy

Our editorial team and automated systems work tirelessly to verify deals, validate promotional coupon codes, and monitor price fluctuations across major Indian e-commerce stores. However, e-commerce pricing is dynamic:

• Rapid Price Changes: Merchants may alter prices, end flash sales, or exhaust promotional stock at any time without prior notice.
• Merchant Price Prevails: In the event of any discrepancy between the price shown on TopDeals India and the price displayed on the merchant's checkout page, the merchant's checkout price shall always be authoritative and final.
• Coupon Terms: Coupon codes may be subject to minimum order values, brand exclusions, bank-specific card offers, or user-tier limitations imposed by the respective retailer.

4. User Conduct & Acceptable Use

When using TopDeals India, you agree not to:

• Use any automated crawler, spider, scraper, bot, or script to harvest data, product listings, coupon databases, or articles without our prior written consent.
• Engage in any denial-of-service (DoS) attacks, flood requests, or attempt to circumvent rate-limiting mechanisms.
• Attempt to probe, scan, or test the vulnerability of our system or network, or breach security or authentication measures.
• Submit false, misleading, fraudulent, or abusive deal tips, reviews, or user feedback.
• Use the Platform for any unlawful purpose or in violation of any local, state, national, or international law.

5. Affiliate Links & External Third-Party Sites

The Platform contains links to external websites operated by third-party merchants. We participate in affiliate marketing programs, including the Amazon Associates Program, Flipkart Affiliate Network, and other affiliate partnerships.

6. Intellectual Property Rights

All content on TopDeals India—including but not limited to platform design, logos, editorial text, graphics, icons, software algorithms, and compilation of deal data—is the proprietary property of TopDeals India and protected under the Indian Copyright Act, 1957 and Trade Marks Act, 1999.

Third-party brand names, store logos (e.g. Amazon, Flipkart, Myntra, Apple, Sony, Samsung), and product trademarks displayed on our site remain the sole property of their respective trademark holders. Their display on TopDeals India constitutes fair nominative use solely for comparative and informational purposes.

7. Disclaimer of Warranties

THE PLATFORM AND ALL CONTENT, FEATURES, AND TOOLS (INCLUDING THE PRICE TRACKER AND COUPON DIRECTORY) ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TOPDEALS INDIA EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OF MERCHANT DEALS, OR CONTINUOUS UNINTERRUPTED ACCESS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE INDIAN LAW, IN NO EVENT SHALL TOPDEALS INDIA, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES, OR LOSS OF PROFITS ARISING OUT OF OR IN CONNECTION WITH:

• YOUR USE OF OR INABILITY TO USE THE PLATFORM;
• ANY PRODUCT OR SERVICE PURCHASED FROM A THIRD-PARTY MERCHANT;
• INACCURATE PRICING, EXPIRED COUPONS, OR OUT-OF-STOCK MERCHANDISE;
• UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA.

9. Indemnification

You agree to defend, indemnify, and hold harmless TopDeals India, its affiliates, officers, and employees from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorney fees) arising out of your violation of these Terms or misuse of the Platform.

10. Governing Law & Dispute Resolution

These Terms and your use of the Platform shall be governed by and construed in accordance with the laws of the Republic of India, without regard to conflict of law principles.

Any legal action, suit, or proceeding arising out of or related to these Terms shall be instituted exclusively in the competent courts situated in New Delhi / NCR, India.

11. Policy Modifications & Contact

We reserve the right to revise, update, or modify these Terms at any time. Changes will take effect immediately upon posting to the Platform with an updated “Last Reviewed” date. Your continued use of the Platform after such modifications constitutes your acceptance of the revised Terms.
